These Terms apply to all visitors, customers, and anyone who requests or receives services from Lancaster Asphalt Paving.
Lancaster Asphalt Paving provides asphalt paving and related contractor services in Lancaster, California and surrounding areas. Services include but are not limited to asphalt paving, sealcoating, crack sealing, pothole repair, parking lot striping, grading and excavation, drainage solutions, and concrete work.
We reserve the right to decline any project at our discretion. Our website is informational and does not constitute a binding offer of services. All service agreements are formalized through a written estimate and, where required, a signed contract prior to work beginning.
Estimates provided by Lancaster Asphalt Paving are based on conditions observed at the time of the site visit and information provided by the customer. Estimates are valid for a limited period from the date issued; material costs, labor rates, and project conditions can change.
If unforeseen conditions are discovered during work - such as base failure, subsurface drainage problems, or utility conflicts not identified before work began - we will notify the customer promptly and discuss any impact on scope or price before proceeding with work beyond the original estimate.
All prices are quoted in United States dollars. We do not guarantee prices quoted online or by phone without a site visit.
Job dates are subject to weather conditions, material availability, and crew scheduling. Asphalt and sealcoating work requires appropriate temperature and dry conditions to be performed correctly. We reserve the right to reschedule jobs due to weather without penalty to either party.
If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible. Cancellations made after mobilization has begun or materials have been ordered may be subject to fees to cover costs incurred.
Customers are responsible for ensuring site access on the scheduled work date, including removing vehicles, clearing the work area, and notifying us of any underground utilities or site conditions that could affect the job.
Payment terms will be specified in your written estimate or project agreement. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, a deposit may be required prior to scheduling.
Accepted payment methods will be communicated at the time of your estimate. Late payments may be subject to interest charges as permitted under California law. If collection action becomes necessary, the customer agrees to be responsible for reasonable collection costs, including attorney fees, to the extent permitted by law.
Title to any materials supplied by Lancaster Asphalt Paving remains with us until full payment is received.
Any workmanship warranty provided by Lancaster Asphalt Paving will be stated explicitly in your written project agreement. Where no written warranty is provided, work is delivered as-is based on the scope agreed upon.
Warranties do not cover damage caused by: customer misuse, heavy equipment loads not disclosed at time of estimate, standing water from drainage issues outside our scope of work, tree root intrusion, subsurface soil movement, vandalism, or extreme weather events.
To the fullest extent permitted by California law, Lancaster Asphalt Paving makes no implied warranties beyond those expressly stated in writing. We do not warrant that asphalt or sealcoating will be free from future weathering, fading, or natural wear consistent with the material.
To the maximum extent permitted by applicable law, Lancaster Asphalt Paving shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this website or from services provided, including but not limited to loss of business, loss of revenue, or property damage not directly caused by our negligence.
Our total liability to you for any claim arising out of or related to our services shall not exceed the amount you paid us for the specific project giving rise to the claim.
You agree to provide accurate information when requesting services. You are responsible for disclosing any known subsurface conditions, underground utilities, drainage issues, or access restrictions before work begins.
If site conditions differ materially from what was described at the time of estimate, we reserve the right to adjust the project scope and price accordingly, with your approval before proceeding.

If you have a concern about our work or billing, please contact us first. We are a local business and we take our reputation seriously. Most issues can be resolved through direct communication.
If a dispute cannot be resolved informally, the parties agree to attempt non-binding mediation before pursuing litigation. Any legal action shall be brought in the appropriate court in Lancaster, California.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in California.
